Terms of Service

Not for navigation. Threshold is a pre-flight situational awareness tool. It is not a certified electronic flight bag, not an approved source of aeronautical information, and not a substitute for an official preflight briefing. It must not be used as a primary source for flight planning or in-flight navigation. Verify all information against official sources before flight. See Data Sources for where this information originates and its limitations.

1. Acceptance of terms

By accessing or using Threshold, you agree to be bound by these Terms of Service, including the Licensed Application End User License Agreement (the “Standard EULA”) provided by Apple. See the Apple Standard EULA.

2. Scope of license

The license granted to you for Threshold by Pollard Labs LLC is a non-transferable license to use Threshold on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple App Store Terms of Service.

3. Disclaimer of warranties

Threshold is provided “as is” and “as available,” without warranty of any kind. Pollard Labs LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

4. Limitation of liability

To the extent not prohibited by law, Pollard Labs LLC shall not be liable for any personal injury, or any incidental, special, indirect or consequential damages whatsoever, including without limitation damages for loss of profits, data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use Threshold.

5. Aeronautical information and user responsibility

Threshold is intended solely as a supplemental pre-flight situational awareness tool. It is not a certified electronic flight bag, is not an approved source of aeronautical information, and does not satisfy any regulatory requirement for a preflight briefing or for current aeronautical charts.

Aeronautical data in Threshold originates with the Federal Aviation Administration and is redistributed without alteration to its substance. It may nevertheless be incomplete, delayed, or out of date relative to the current publication cycle. Charts and airport data are revised on FAA publication cycles and cached copies may lag those cycles. Special use airspace and restricted areas may change at any time; refer to NOTAMs for current information.

Weather information is advisory. Radar imagery is generated by an automated process and may contain artifacts or omissions.

You are the pilot in command. You must verify the accuracy, currency and reliability of all information presented by Threshold against official sources before flight, and you use it at your own risk. Threshold is not endorsed, approved or authorized by the Federal Aviation Administration.

6. Subscriptions and billing

Threshold is offered on a subscription basis through the Apple App Store. Payment is charged to your Apple ID account on confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your Apple ID account settings. Any unused portion of a free trial is forfeited when a subscription is purchased.

7. Data use and privacy

Threshold collects no personal information. See the Privacy Policy.

8. Termination

This license is effective until terminated by you or by Pollard Labs LLC. Your rights terminate automatically without notice if you fail to comply with any term.

9. Intellectual property

All content in Threshold is the property of Pollard Labs LLC or its licensors and is protected by copyright law, except for United States Government material as described on the Data Sources page, which is not subject to copyright protection in the United States.

10. Legal compliance

You must comply with applicable laws regarding use of the app and must not export or re-export Threshold unlawfully.

11. Governing law

This agreement is governed by the laws of the State of Alabama, excluding its conflict of laws rules.

12. Modifications

Pollard Labs LLC reserves the right to modify these terms. Continued use of Threshold after changes constitutes your consent to the changes.

13. Arbitration agreement

Any dispute or claim arising from or relating to these Terms or your use of Threshold will be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

14. Third-party beneficiary

Apple, Inc. and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. External services

Threshold may enable access to third-party services and websites. You agree to use those at your own risk, and Pollard Labs LLC is not responsible for examining or evaluating their content or accuracy.

16. No warranty from Apple

In the event of any failure of Threshold to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Threshold.

17. Apple's liability

Apple is not responsible for addressing any claims by you or any third party relating to Threshold or your possession or use of Threshold, including product liability claims, any claim that Threshold fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
